Welcome to Best AI Tools (the "Site"), operated by BitAutor UG (haftungsbeschränkt) ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at https://best-ai-tools.org and any related services provided by us (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, do not access or use the Service.

1. Use of Our Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all your activity in connection with the Service. The Service is intended for users who are at least 18 years old (or the applicable age of majority in your jurisdiction). Minors may not use the Service.

2. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by BitAutor UG (haftungsbeschränkt), its licensors, or other providers of such material and are protected by German and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are granted a limited license only for purposes of viewing the material contained on this Service.

3. User-Generated Content

If the Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Contributions"), you are responsible for the User Contributions that you post to the Service, including its legality, reliability, and appropriateness. By submitting User Contributions, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Contributions throughout the world in any media in connection with the Service. You represent and warrant that you own or control all rights to your User Contributions and have the right to grant this license to us. We reserve the right, but not the obligation, to monitor, edit, or remove any User Contribution for any reason.

EU Digital Services Act (DSA) Compliance: In accordance with DSA Article 14 (Transparency reporting), we provide transparency about our content moderation practices. We use automated systems and human moderation to review user-generated content for compliance with our Terms and applicable laws. We maintain procedures for handling notices of allegedly illegal content (DSA Article 11/12) and provide a single point of contact at admin@best-ai-tools.org for such notices in German and English.

Content Moderation: We moderate content based on our Terms of Service and applicable laws. We do not engage in comprehensive editorial review of all user-generated content. Our moderation focuses on removing content that is clearly illegal, violates our Terms, or poses a risk to user safety. We are not obligated to monitor all content proactively under DSA Article 7 (Mere Conduit) and E-Commerce Directive principles.

AI Assistant and Chatbot

The Service may offer an AI assistant or chatbot feature (the "AI Assistant") that suggests tools or provides informational answers based on your prompts. The AI Assistant is provided for general informational purposes only and does not provide legal, medical, financial, or other professional advice. You must not rely on any AI-generated content as a substitute for independent professional judgment.

You agree not to input any special categories of personal data (such as health information, political opinions, religious or philosophical beliefs, trade-union membership, sexual orientation, or similar sensitive data) into the AI Assistant. You remain solely responsible for how you interpret and use any AI-generated content and for any decisions or actions you take based on such content.

We do not guarantee that AI-generated content will be accurate, complete, or up-to-date. To the maximum extent permitted by law, and in addition to the exclusions and limitations of liability set out in these Terms, we disclaim any liability for decisions or actions you take in reliance on AI-generated content.

4. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

5. Indemnification

You agree to indemnify, defend, and hold harmless BitAutor UG (haftungsbeschränkt) and its directors, officers, employees, and agents from and against any and all third-party claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, including without limitation any copyright, property, or privacy right, or (d) any User Contributions you submit or transmit through the Service, in each case to the extent caused by your willful, negligent, or unlawful conduct. This obligation will survive the termination of these Terms and your use of the Service.

6. Disclaimer of Warranties and Limitation of Liability

TO THE EXTENT PERMITTED BY LAW AND SUBJECT TO MANDATORY RIGHTS:

(a) Disclaimer of Warranties: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Statutory warranty rights of consumers remain unaffected.

(b) Liability for slight negligence: For losses (other than injury to life, body, or health) caused by simple negligence, we are liable only for breaches of essential contractual obligations (cardinal duties); in that case liability is limited to typical, foreseeable damage. Otherwise, liability for simple negligence is excluded.

(c) Business customers: Where you act as a business (not a consumer), our total aggregate liability arising out of these Terms or the Service is capped at the greater of (i) EUR 100, or (ii) the fees paid by you to us in the six (6) months prior to the event. This cap does not apply to the mandatory liability described below.

(d) Mandatory liability (German law): Nothing in these Terms limits or excludes liability for intent, gross negligence, injury to life, body, or health, fraudulent concealment, guarantees, claims under the Product Liability Act, or any other liability that cannot be excluded or limited under mandatory law.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. You may have additional rights which vary by jurisdiction.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

10. Partner and Sponsorship Services

In addition to free directory listings, we offer paid partner and sponsorship services (for example featured listings, newsletter placements, sponsored comparison placements and content collaborations) as described on our /partner page or in individual offers.

These services are intended exclusively for business customers acting in the course of their trade or profession. They do not constitute consumer contracts, and statutory consumer withdrawal rights do not apply. Unless expressly agreed otherwise in writing, we do not guarantee any specific level of traffic, sign-ups, revenue, rankings or other performance outcomes. Any performance figures, case studies or testimonials are illustrative only.

Partners are solely responsible for the legality, accuracy and non-infringing nature of any content, logos, claims or materials they provide. By submitting such materials, partners grant us a non-exclusive, worldwide, royalty-free licence to use their name, logo and provided assets for the purpose of delivering the booked services and for reasonable marketing references (for example, case studies or "featured on" sections).

Fees, applicable taxes, timing, cancellation and rescheduling conditions for each service are as described on the /partner page or in the relevant order confirmation. We reserve the right to remove or suspend partner content that we reasonably consider unlawful, misleading or harmful, without waiving any fees already due.

Mobile Application Supplement

The following terms apply specifically to the Best AI Tools mobile application ("App") available on Apple App Store and Google Play.

1. Scope & Acceptance

These App Terms govern your use of the Best AI Tools mobile application. By installing or using the App, you confirm that you are at least 18 years old (App Store rating 17+ corresponds to an adult audience) or the applicable age of majority in your jurisdiction. If local law requires parental consent for users under 18, you confirm such consent has been obtained. You accept these Terms and our general Terms of Service above.

2. License Grant

We grant you a non-exclusive, non-transferable, revocable license to install and use the App solely for personal, non-commercial purposes, subject to these Terms and the applicable app store rules.

3. App Store Specific Clauses

Apple App Store (iOS): These Terms are between you and BitAutor UG (haftungsbeschränkt), not Apple Inc. Apple is not responsible for maintenance, support, or any claims relating to the App or its content. You acknowledge that Apple may enforce these Terms against you as a third-party beneficiary.

Google Play (Android): Distribution through Google Play is governed by the Google Play Developer Distribution Agreement. Google is not responsible for App functionality, security, or content.

4. Updates & Availability

We may update or discontinue the App or its features at any time without notice. Updates may be required to continue using the App. The App is provided "as is" and "as available."

5. User Accounts

If the App requires sign-in or tool submission, you must provide accurate information and keep your account credentials secure. You remain responsible for all activity under your account.

6. App Permissions

The App may request limited permissions (e.g., internet access, storage for caching, push notifications). All permissions are strictly required for functionality and disclosed before activation. See the App Permissions Transparency section below for details.

7. Third-Party Content & Links

The App lists third-party AI tools. We neither host nor control such tools and are not liable for their availability, accuracy, or compliance. You use external tools entirely at your own risk. Note: Adult content tools are not displayed in the mobile app.

8. App Termination

We may suspend or terminate your access to the App if you violate these Terms or applicable laws. Upon termination, all license rights cease immediately and you must uninstall the App.

9. App Liability & Warranty

The App and its content are provided "as is" and "as available." To the fullest extent permitted by law, BitAutor UG (haftungsbeschränkt) disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Statutory consumer rights remain unaffected.

For simple negligence, we are liable only for breaches of essential contractual obligations (cardinal duties) and then only for typically foreseeable damage. Otherwise, liability for simple negligence is excluded. BitAutor UG (haftungsbeschränkt) ("us", "we", or "our") operates the https://best-ai-tools.org website (the "Service"). This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. See our Cookie Information section for details on cookie usage.

1. Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Types of Data Collected:

  • Personal Data: While using our Service (e.g., when submitting a tool, creating a profile, or subscribing to our newsletter), we may ask you to provide us with certain personally identifiable information ("Personal Data"). This may include, but is not limited to: Email address, Name, and any data you voluntarily provide in forms.
  • Usage Data: We may collect information on how the Service is accessed and used ("Usage Data"), such as your computer's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

AI Assistant and Chatbot

When you use our AI assistant or chatbot features (the "AI Assistant"), we process the content of your prompts and related technical information in order to provide answers and tool recommendations.

Data we process. This includes: the questions and follow-up messages you type into the AI Assistant; the conversation history within the current session; references to tools in our directory (for example internal tool IDs used as context for the answer); and technical metadata such as timestamps, language/locale, latency, pseudonymous identifiers (for example your account ID or an anonymous ID), and basic device/browser information.

Purposes. We use this data to provide and improve the AI Assistant experience and recommend relevant tools; to prevent abuse and enforce reasonable usage limits; and to monitor performance, debug issues, and improve the quality and safety of the AI Assistant (primarily in aggregated or pseudonymised form).

Legal basis. The legal bases under Article 6 GDPR are: Art. 6(1)(b) GDPR (performance of a (quasi-)contract when you actively use the AI Assistant as part of our services); and Art. 6(1)(f) GDPR (our legitimate interests in securing the service, preventing abuse and improving the AI Assistant). Where we rely on consent for additional analytics or personalisation, the legal basis is Art. 6(1)(a) GDPR, and you can withdraw consent at any time.

Please do not submit any special categories of personal data (for example health data, political opinions, religious or philosophical beliefs, trade-union membership, sexual orientation or similar sensitive information) into the AI Assistant.

Retention. We keep detailed AI Assistant logs only for as long as necessary for the purposes above and then either delete or irreversibly aggregate the data so that it can no longer be linked to you as an individual.

AI Model Provider and International Data Transfers

To generate AI Assistant responses, we use large language models ("LLMs") provided by carefully selected third-party cloud providers. When you submit a prompt to the AI Assistant, the text of your prompt and relevant context may be transmitted to these providers for processing. This may involve transfers of personal data to countries outside the European Economic Area, in particular the United States.

Such transfers are based on appropriate safeguards under Chapter V GDPR, typically EU Standard Contractual Clauses (SCCs) and additional technical and organisational measures implemented by the providers. You can find more information in the privacy documentation of the respective provider.

2. Legal Basis for Processing Personal Data (GDPR Art. 6)

If you are from the European Economic Area (EEA), our legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it. We process your Personal Data based on the following legal grounds under GDPR Article 6(1):

  • Consent (Art. 6(1)(a) GDPR): Newsletter subscriptions, optional analytics cookies, and any other processing where you have explicitly consented. You may withdraw your consent at any time.
  • Contract Performance (Art. 6(1)(b) GDPR): User account creation and management, tool submission processing, and any services you specifically request from us. Processing is necessary to fulfill our contractual obligations to you.
  • Legal Obligation (Art. 6(1)(c) GDPR): Tax record retention, compliance with court orders, responding to lawful requests from authorities, and other processing required by applicable law.
  • Legitimate Interests (Art. 6(1)(f) GDPR): Essential website analytics to improve our service, fraud prevention and security measures, platform optimization, and internal administration. Our legitimate interest is to operate, maintain, and improve our service efficiently and securely. We have balanced this interest against your fundamental rights and freedoms and ensure we do not process your data in ways you would not reasonably expect. You have the right to object to processing based on legitimate interests.

We will assess your specific situation and cease processing unless we demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing is necessary for legal claims.

3. Data Security and Retention

The security of your data is important to us. We use commercially acceptable means to protect your Personal Data, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy and to comply with our legal obligations.

California Privacy Rights (CCPA/CPRA) - Detailed Compliance

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), effective January 1, 2023, with full enforcement beginning February 2024.

  • Internet or Electronic Network Activity: Browsing history, search history, interaction with our website, app usage data

How to Exercise Your California Rights

To exercise your rights, please contact us at admin@best-ai-tools.org with:

  • Your full name and email address associated with your account
  • A clear description of which right(s) you wish to exercise
  • Verification information (we may ask for additional information to verify your identity)

We will respond to verified requests within 45 days (or 90 days for complex requests, with notification). We may charge a reasonable fee or refuse requests that are excessive, repetitive, or manifestly unfounded.

Verification Process (CCPA/CPRA Section 7060)

We implement reasonable verification methods based on the sensitivity of the data and risk of harm:

  • Account Holders: Verification through existing authentication practices (email confirmation, password verification)
  • Non-Account Holders: Verification using at least two data points matching information we already hold (e.g., email + IP address, email + device identifier)
  • Unverifiable Requests: If we cannot verify your identity for a "request to know" specific pieces of information, we will not disclose that information but may treat the request as a general inquiry about categories of data

Do Not Sell or Share My Personal Information

We do NOT sell your personal information or share it for cross-context behavioral advertising in the sense of CCPA/CPRA. We do not engage in the sale of personal information as defined under California law.

We may share information with service providers (e.g., Firebase, hosting providers) under written contracts that prohibit them from using your information for their own purposes. This is not considered a "sale" under CCPA/CPRA.

Authorized Agents

You may designate an authorized agent to make requests on your behalf. The agent must provide proof of authorization (e.g., signed power of attorney or written permission) and we may still require verification of your identity directly.

New York Privacy Rights (NYCDPA) - Child Data Protection

Effective June 20, 2025, the New York Child Data Protection Act (NYCDPA) provides additional protections for users under 18 years of age.

Age Flags and Verification

We respect age flags—signals from your device, browser settings, or plug-ins indicating you are a minor. If we receive such a signal or have actual knowledge that you are under 18, we will treat you as a covered user under NYCDPA.

Protections for Minors

For users under 18:

  • No Sale of Data: We do not sell or purchase personal data of covered minors
  • Consent Requirements: For users aged 13-17, we only process personal data that is strictly necessary for our service or with informed consent
  • COPPA Compliance: For children under 13, we comply with federal COPPA standards
  • Limited Processing: We limit data collection and processing to what is necessary for service provision

Parental Rights

Parents or guardians of users under 18 may exercise privacy rights on behalf of their children, including the right to access, delete, or correct their child's personal information. To exercise these rights, contact us at admin@best-ai-tools.org with proof of parental relationship.

New York SHIELD Act Compliance

Effective December 2024, we comply with New York SHIELD Act requirements:

  • Data Breach Notification: We will notify New York residents of data breaches within 30 days of discovery
  • Expanded Private Information: As of March 25, 2025, "private information" includes medical and health insurance data
  • Reasonable Security: We implement reasonable administrative, technical, and physical safeguards to protect personal information

5. Service Providers and Third Parties

We may employ third-party companies and individuals to facilitate our Service ("Service Providers"), such as using Firebase for authentication and analytics. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. Our Service contains links to other sites not operated by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Payments and Stripe

For paid partner and sponsorship services (for example on our /partner page), we use Stripe to process payments. When you enter your payment details, this information is collected and processed directly by Stripe and not by us. Stripe may process data such as your name, email address, billing address, payment card details, transaction amount and date, under its own terms and privacy policy.

The legal basis for processing payment-related data on our side is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(c) GDPR (compliance with legal obligations, for example tax and accounting laws). For more information on how Stripe processes your data, please refer to Stripe's own Privacy Policy.

First-Party Analytics and Internal Metrics

In addition to third-party analytics tools that require your consent, we operate our own first-party analytics and internal metrics system based on our infrastructure (for example our Firebase/Firestore databases).

Data we collect. This may include: page views, referrers and basic page-level metrics; interactions with elements such as calls-to-action, comparison views, favourites, ratings or social share buttons; learning and discovery actions (for example searches, navigation events, AI Assistant usage, compare page views); and pseudonymous identifiers (such as your account ID or an anonymous ID), timestamps, URLs and page types.

Purposes. We use this first-party analytics data to operate, secure and debug our services; understand which content and tools are used and improve the user experience; and detect abuse, anomalies and technical issues.

Legal basis. The legal basis is Art. 6(1)(f) GDPR (legitimate interests) in operating a secure, reliable and high-quality service. We have balanced these interests against your rights and expectations and limit data access and retention accordingly. You have the right to object to processing based on legitimate interests under Art. 21 GDPR. You can exercise this right by contacting us using the details provided in this Privacy Policy.

6. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "last updated" date at the top of this Privacy Policy.

Mobile Application Privacy Supplement

The following privacy practices apply specifically to the Best AI Tools mobile application.

7. Data Collected via the Mobile App

In addition to the data described above, our mobile app may collect:

  • Device & Technical Data: Device identifiers (device ID), operating system version, app version, crash logs, and diagnostic information for security and performance optimization.
